For Consumers – Beaconnected Mobile App

The Beaconnected app is free to download for use by the general public and will provide access to retail and other businesses with notifications about products at special prices, clearances and updates on events and community information, to help make your shopping and entertainment choices a better experience.

1. General

By installing the Beaconnected App you agree to be bound by these terms of use. Please read carefully before accepting and downloading the App.

2. Definitions

The App means the software provided by Myadd Pty Ltd (ABN 82 323 671 619), as the Beaconnected app to be used on Apple iOS and Android OS devices and shall include from time to time any upgrades other software or documentation which enables the use of the app.

3. Data Protection

Any personal information you supply to Beaconnected when using the App will be used by as the founder and owner of the App in accordance with its Privacy Policy.

4. General Use

The Application allows you to access certain functionality available on Beaconnected.com.au website

5. Proprietary Rights and Licence

Copyright, database rights and other intellectual property rights of any nature in the App together with the underlying software code are owned Myadd Pty Ltd.

6. General Misuse

Myadd Pty Ltd and Beaconnected are not responsible for the content of the message and consumers should report any non-valid or disreputable notifications to the founder immediately so that the sender can be removed as a Beaconnected merchant.

7. System Requirements

This App is designed for iPhone, iPad and iPod touch devices

Compatibility: Requires iOS 6.0 or later. Compatible with iPhone, iPad, and iPod touch with Bluetooth 4.0.

The version of the application software may be upgraded from time to time to add support for new functions and services.

8. Pricing

Beaconnected does not sell goods or services on behalf of its Merchants. Beaconnected does not sell any merchandise directly or otherwise to wholesales, consumers or any other commercial enterprise as we are not an on-line retail store. Therefore, there are product prices.

9. Refund Policy

Beaconnected is a subscription based product, where Merchants, agree to a subscription period where in the Merchant is provided with an agreed number of beacons by Myadd Pty Ltd so that they can send notifications to consumers who have downloaded the free beaconnected app. Therefore there are no on line sales which means there are no refunds.

10. Shipping

Beaconnected is not an on-line retail store. Therefore, there are no shipping costs as there are no products sold to be shipped.

For Merchants – Beaconnected Portal

1. Conditions of Use

The Beaconnected Beacons can only be placed with a business that has been authorised by the founder of Beaconnected; Myadd Pty Ltd (ABN 82 323 671 619) and upon acceptance of these Terms and Conditions of supply and use.

2. A business or any other parties on behalf of the business that cannot

a) make and distribute copies of the Beacons
b) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the Beacons
c) create derivative works of the Beacons in anyway whatsoever.

3. The Beacons are supplied by Myadd Pty Ltd and available to merchants for a deposit, $150+ GST in accordance with the package that is purchased for the period nominated and agreed to.

4. At termination of the agreed period, the Beacons are to be returned to Myadd Pty Ltd and must be in working order to receive a return of your deposit.

5. Beacons must be placed within the businesses premises.

6. The content and notifications that the business sends to consumers must be relevant to the store, promotion or the intent for which the service has been provided to you.

7. General misuse

Myadd Pty Ltd and Beaconnected are not responsible for the content of the message, however, misuse of the Beaconnected service will result in removal of your business from the Beaconnected group of merchants.

8. Termination

Breach of any of the terms and conditions will result in instant termination of the service and use of Beacons. Legal action may be taken if warranted, in accordance with the level of breach of the terms and conditions; clauses 1 to 7.

9. The Product

Beaconnected is a community-based proximity service app that allows users to receive exclusive offers, store information and promotions direct to their phone when they enter within a dedicated proximity of a participating business’ beacon.

Developed by Myadd Pty Ltd (ABN 82 323 671 617), Beaconnected is a subscription based marketing software / App that allows Beacons to transmit low energy Bluetooth signals to smart phones and tablets within a pre-determined geographical range.

10. Purchasing

The Beaconnected product is only available from Myadd Pty Ltd to approved businesses currently throughout South Australia, Victoria and New South Wales.

The approved business (the Purchaser) is able to purchase the Beaconnected product; the app and beacons plus the user subscription either on line or in person by contacting their Myadd marketing representative. If you do not have a Myadd marketing representative, we will appoint one to your business.

11. The Term

The Purchaser must enter into at least a minimum subscription term of 6 months, (the Minimum Term) whereupon payment is made on signing and in advance of commencement. Thereafter, the Purchaser will be required to pay in advance, monthly for the term of the subscription.

12. Deposit and Payment

On commencement; the Purchaser will be required to pay a deposit of $150 for the Beacons (Hardware)

Number of Beacons covered within this deposit equals; 1 – 3. If you require more than 3, your Myadd representative will contact you.

On full payment of the commencement of the subscription and the Hardware deposit, the Purchaser will receive access to the app once the Hardware is delivered, either by COD or within 3-5 business days if ordered online.

Monthly subscription rates vary depending on which package the Purchaser chooses, as shown on this website.

13. Cancellation

If the Purchaser wishes to cancel prior to the expiration of the subscription term, written notice to Myadd Pty Ltd (the Supplier) will be required no less than 13 weeks prior to the expiration of the Minimum Term or 60 days prior to the chosen term for the subscription. (eg: 9, 12, 15 or 18 months) The Purchaser will then receive notice from the Supplier verifying the cancellation and amounts due which will be invoiced and paid in full prior to the acknowledged cancellation date stated.

All Beacons will need to be returned to the Supplier precisely one working day after the date of subscription expiration, irrespective of whether the expiration date is reached due to the end of the full term or due to cancellation by the Purchaser or the Supplier.

The Supplier reserves the right to cancel a Purchasers subscription, and must provide the Purchaser with 30 days written notice; citing the reason for cancellation which could encompass the following reasons or acts by the Purchaser; including but not limited to damaging the Supplier’s brand, reputation or misconduct and unauthorised use of either the; Hardware, the app or the bona fide service and application of the supplier’s technology and good faith subscription provisions.

On receipt of all Hardware, the Supplier’s technical division will check the devices to ensure they are in working order. Upon the Supplier’s verification that the Hardware is in good order and working, the Purchaser will receive their Hardware deposit refund.

14. Hardware Faults

The Supplier will; in good faith issue the Purchaser with the Hardware with the understanding that should the Hardware be faulty or malfunction, the supplier will assess the situation and replace the Hardware at no expense to the Purchaser, providing that the fault or malfunction is not a direct result of mishandling or miss use by the Purchaser.

18. Subscriptions

The Beacons are supplied by Myadd Pty Ltd and available to merchants for a deposit, $150+ GST in accordance with the package that is purchased for the period nominated and agreed to. Deposit will be refunded on return by the Merchant to Myadd Pty as specified in the terms and conditions.

19. Social Media

By subscribing to Beaconnected and agreeing to these Terms and Conditions, the Merchant agrees to allow Beaconnected and Myadd Pty Ltd to promote their business and Beaconnected offers on social media including but not limited to: Facebook, Instagram, Twitter, Google Plus, LinkedIn and YouTube. It is the Merchant’s responsibility to contact Myadd Pty Ltd if preffered that offers are not promoted on social media. Not all offers will be promoted by Beaconnected and Myadd Pty Ltd.
